Frequently asked questions
Common questions
When do I need a habitability certificate (cèdula d’habitabilitat)?
To sell or let a home, to connect utilities and, often, to arrange a mortgage. New homes need a first occupancy certificate and existing ones a second occupancy certificate, which is valid for fifteen years.
Do I need an energy performance certificate to sell or let?
Yes. When a home or business premises is put up for sale or rent, the certificate must be registered with ICAEN and its energy label shown in the advertisements. It is valid for a maximum of ten years.
Does my building need a technical inspection (ITE)?
In Catalonia, blocks of flats must pass the inspection once they are 45 years old, under Decree 67/2015, and also before applying for renovation grants. We can tell you whether and when your building needs one.
Do I need a project to renovate my home?
It depends on the scope. Work affecting the structure, the overall layout, the façade or the use of the building normally requires a technical project and a building licence; smaller renovations can often be carried out with a prior notification to the town council. Each council has its own by-laws, so we will tell you which procedure applies before you start.
Do you act as expert witnesses in court cases?
Yes. We write expert reports on building defects and faulty workmanship and ratify them in court. Josep Fàbregas is a qualified expert witness on building defects (Universitat de Girona).
Which areas do you cover?
Our office is in Torroella de Montgrí, in the Baix Empordà, and we work throughout the province of Girona and the Costa Brava for homeowners, residents’ associations, property managers, developers, investors and public bodies.
